Who we are
SwornVoice LLC is a California company based in Burbank, California ("SwornVoice", "we", "us").
These terms apply to each law firm that uses SwornVoice ("your firm", "you") and its authorized users.
The service
SwornVoice works like this:
- We text each person on your witness list for consent.
- An AI interviewer calls everyone who agrees, in English or Spanish. We record the call only with consent.
- Calls run on weekdays from 9 to 5 in the witness's own time zone, with up to 4 tries per person. We never call anyone on the do-not-contact list.
- We draft a declaration from each transcript and check the quotes it cites against the transcript.
- Your attorney reviews and approves each draft in the hub, your firm's private SwornVoice workspace.
- After approval, the witness can sign on their phone. They get a texted link and a one-time code, and you get a sealed PDF with a certificate page.
Drafts are not legal advice or evidence
SwornVoice is not a law firm and does not practice law. A draft declaration is an interview memo formatted as a pleading. It is not legal advice and it is not evidence.
Your firm is responsible for having an attorney review every draft and confirm its contents with the witness before it is used.
Your firm decides whether to send each approved draft for signature, and makes every filing and litigation decision.
Your firm's responsibilities
Your firm warrants that it has a lawful basis to contact each person on the lists it gives us.
Your firm warrants that the automated calls and texts made for it comply with the Telephone Consumer Protection Act (TCPA) and state law.
You will tell us promptly about anyone who must not be contacted, and we will add them to the do-not-contact list.
Scripts and text wording
Your firm approves the interview script before any call goes out.
Your firm approves the wording of the consent text and the signing texts, in each language, before any text goes out.
If approved wording changes, it must be approved again before it is used.
The texts witnesses get are described in the text messaging section of our privacy policy.
Billing
Billing follows the prices on our pricing page in effect when your firm uploads a list. If this page and the pricing page differ, the pricing page controls. The standard prices today are:
- $3.60 per person on the list, paid at upload, which covers 5 claims.
- Each extra claim adds $0.42 per person.
- $3 per claim on every answered call that becomes an interview, signed or not (5 claims = $15 per interview).
- No charge for calls that never become an interview.
- A $1,200 minimum per case.
Confidentiality
We treat interview materials as confidential case materials. We disclose them only to your authorized users and to the providers we need to run the service.
We keep them for the life of the engagement unless you tell us otherwise. Our privacy policy explains retention.
Limit of liability
The service is provided as is. Our total liability for all claims arising from a case is capped at the fees your firm paid us for that case.
We are not liable for indirect or consequential damages, or for any decision about how a draft is used, which is your firm's decision.
Text messaging
This section covers our text message program, SwornVoice witness outreach.
- Program name
- SwornVoice witness outreach.
- Who gets texts
- People on a law firm's witness list, and witnesses signing a declaration. We text people on a firm's witness list to ask whether they agree to a recorded phone interview for the firm's case. Witnesses signing a declaration get texts with their private signing link and a one-time code.
- Message frequency
- 1 to 2 consent texts per person, plus up to 7 texts around signing (the link, the one-time code, reminders, and a copy of the signed declaration).
- Cost
- Message and data rates may apply.
- Opting out and help
- Reply STOP to opt out, HELP for help. When a person replies STOP, we add their number to our do-not-contact list and stop texting and calling it.
- Your mobile information
- No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
